Cal/OSHA Enforcement in Agriculture

Under the AB 1066 phase-in, agricultural employers with 26 or more employees reached the standard 8-hour-day / 40-hour-week overtime threshold on January 1, 2022, and employers with 25 or fewer employees completed the same phase-in on January 1, 2025. Today, all California agricultural workers are entitled to overtime pay after 8 hours in a day or 40 hours in a week, and double-time pay after 12 hours in a day, the same standard that applies to non-agricultural employees, ending the agricultural overtime exemption that had been in place since the Fair Labor Standards Act was enacted in 1938.
The current California minimum wage applies to all agricultural workers regardless of employer size. Effective January 1, 2026, this rate is $16.90 per hour, though many agricultural regions have local minimum wage ordinances that set higher rates. Employers must pay whichever rate is highest, federal, state, or local. Piece-rate workers must receive at least minimum wage for all hours worked, and employers are required to separately compensate piece-rate employees for rest and recovery periods and other nonproductive time at the worker's average hourly piece-rate earnings for the pay period.
Wage statement requirements under Labor Code Section 226 are among the most litigated provisions in California employment law. Every pay stub must include gross wages earned, total hours worked (with separate entries for overtime hours at applicable rates), piece-rate units earned (if applicable), all deductions, net wages earned, the pay period dates, the employee's name and last four digits of their Social Security number, the employer's legal name and address, and all applicable hourly rates with corresponding hours worked at each rate. Missing or inaccurate wage statements expose employers to statutory penalties of $50 for the first violation and $100 for each subsequent pay period, per employee, a liability that compounds rapidly across large workforces.
Rest and meal break compliance is another area where agricultural employers face heightened scrutiny. California requires a paid 10-minute rest period for every 4 hours worked (or major fraction thereof) and an unpaid 30-minute meal period no later than the end of the fifth hour of work. Premium pay of one additional hour at the employee's regular rate is owed for each day a compliant meal or rest period is not provided. Field Sanitation and Heat Illness Standards
California's field sanitation standard (Title 8 Section 3457) exceeds federal OSHA's field sanitation requirements (29 CFR 1928.110) in several important respects. Drinking water must be “fresh, pure, suitably cool” and provided in sufficient quantity, Cal/OSHA interprets this as a minimum of one quart per worker per hour for the entire shift. Cups must be single-use or individually marked, and the water supply must be replenished throughout the day as needed.
The Heat Illness Prevention Standard (Section 3395) is California's most enforced agricultural safety regulation. It requires employers to provide access to shade structures that accommodate all employees on recovery or rest periods when temperatures exceed 80 degrees Fahrenheit. Shade must be open and available to workers at all times, employers cannot require workers to request shade access. High-heat procedures activate when temperatures reach 95 degrees, requiring mandatory buddy systems, pre-shift meetings to discuss heat hazards, and observation of workers for signs of heat illness during the first 14 days of employment or when a heat wave is declared.
Training under the heat illness standard must be provided to all employees and supervisors before they begin work and must cover the environmental and personal risk factors for heat illness, the employer's procedures for complying with the standard, the importance of acclimatization (particularly during the first 14 days of employment or after an absence of 14 or more days), the importance of immediately reporting symptoms, and the procedures for responding to symptoms including emergency medical services protocols. Supervisor training must additionally cover monitoring workers for signs of heat illness and the specific steps supervisors must take in the event of a heat-related emergency.
- Acclimatization protocols are one of the most commonly cited heat illness violations. New employees and those returning from extended absence must be closely monitored during their first 14 days of outdoor work, with workload gradually increased over the acclimatization period.
- Emergency response procedures must include a clear protocol for contacting emergency medical services, providing directions to the worksite (including GPS coordinates for remote field locations), and designating a trained first-aid responder for each work crew.
- Water quantity documentation is increasingly requested during inspections. Employers should maintain records showing the volume of water provided relative to the number of workers and the duration of the shift, particularly during high-heat days.
Pesticide Regulation Under DPR
California's Department of Pesticide Regulation enforces the most comprehensive state pesticide safety program in the country. While the federal Worker Protection Standard (40 CFR Part 170) sets baseline requirements for agricultural pesticide safety, California's regulations under Title 3, Division 6 of the California Code of Regulations impose additional obligations that FLCs must understand and follow. The DPR works in coordination with 56 County Agricultural Commissioners who serve as the primary enforcement arm for pesticide-use violations at the local level.
Pesticide safety training in California must be provided annually to all agricultural employees who work in areas where pesticides are applied, regardless of whether they handle pesticides directly. Training must cover the hazards of pesticide exposure, how to read pesticide labels and Safety Data Sheets, field posting and restricted entry interval (REI) requirements, the location of emergency decontamination supplies, and the worker's right to request information about pesticides applied in their work area. Training must be conducted in a language the workers understand and must be documented with specific records including the trainer's name and qualifications, the date and duration of training, the topics covered, and a list of all attendees.
Pesticide handlers, workers who mix, load, apply, or otherwise directly handle pesticides, must complete annual handler training under 3 CCR Section 6724 before performing any handling task, which goes beyond the fieldworker training required for general field workers. A Qualified Applicator Certificate (QAC) or Qualified Applicator License (QAL) is required in narrower circumstances, such as supervising the use of restricted materials or performing pest control for hire, and trained non-certified handlers may otherwise work under the supervision arrangements the product label and DPR regulations allow. Licensed pest control businesses operating in California must hold a Pest Control Business License from DPR, and certified applicators must pass written examinations covering pesticide laws, safety, and application methods specific to their category of use.
Restricted Entry Intervals are strictly enforced in California and represent a frequent source of violations for FLCs. After a pesticide application, workers may not enter the treated area until the REI has elapsed unless they are performing early-entry tasks under specific exemption conditions. Even early-entry workers must receive additional training and be provided with the PPE specified on the pesticide label. Field posting requirements mandate that treated fields be marked with warning signs at all entrances, displayed in both English and Spanish, and maintained until the REI expires. Sending untrained workers into a field during an active REI is one of the most serious pesticide violations an employer can commit, carrying penalties that include criminal prosecution in egregious cases.
Building a California Compliance Program
Operating a compliant agricultural business in California requires a systematic approach that integrates safety, wage and hour, pesticide, and recordkeeping obligations into daily operations rather than treating them as separate administrative burdens. The most effective compliance programs are built around three principles: documentation happens at the point of activity, supervisors are trained as compliance enforcers, and gaps are identified proactively rather than discovered during inspections.
Documentation at the point of activity means that training is logged when it occurs, not reconstructed days or weeks later. It means time records are captured electronically as workers enter and leave the field, not estimated on paper timesheets at the end of the week. It means shade and water provisions are verified and recorded each morning before crews deploy, not assumed to be in place because they were set up at the beginning of the season. Every compliance obligation that can be documented in real time should be, because reconstructed records are inherently less defensible during an investigation.
Supervisor training is the most underfunded element of most agricultural compliance programs. California regulations place significant compliance responsibilities on field supervisors, they must recognize heat illness symptoms, enforce rest and meal break schedules, verify pesticide REI compliance, ensure proper PPE usage, and respond to workplace injuries.
