Shade access must be available when temperatures exceed 80 degrees Fahrenheit. Shade structures must be open to the air or have ventilation, be large enough to accommodate the number of employees on recovery or rest periods without requiring them to sit in physical contact with one another, and be located as close as practicable to the work area. When temperatures are below 80 degrees, shade must still be available upon request from any employee.
High-heat procedures kick in when temperatures reach or exceed 95 degrees Fahrenheit. Documentation requirements are critical. FLCs must maintain records showing that each employee received training, the date training was provided, the topics covered, and the name and qualification of the trainer. These records must be available for inspection at all times. Many FLCs are cited not because they failed to train their workers, but because they cannot produce documentation proving that training occurred. Verbal-only training with no sign-off sheets is essentially the same as no training in the eyes of an inspector.
Common Violations and How to Avoid Them
The most frequently cited violation is insufficient water supply. The fix is straightforward: assign a specific crew member to monitor and refill water throughout the day, bring backup containers, and never rely on a single source of water for large crews.
Inadequate shade structures represent the second most common citation. Pop-up canopies that have blown over, shade positioned a quarter mile from the work area, or structures too small to accommodate more than a few workers at a time all constitute violations. Invest in durable, properly anchored shade structures and move them as the crew moves through the field. Remember that shade must accommodate every employee on a cool-down rest period simultaneously.
Missing or incomplete written procedures catch many FLCs off guard.
